This Privacy Statement sets out why and how Minerva Professional Language Services Limited (hereinafter Minerva) processes the Personal Data it receives through its website, e-mail, file transfer services, applications, software and any other means for whatever reason. In these circumstances, Minerva is the Data Controller. Minerva’s objective when collecting and processing Personal Data is safeguarding the privacy of individuals. This Privacy Statement is designed to provide transparency on how Minerva processes your Personal Data and to enable you to exercise the control available to you under relevant legislation and regulations.

 

Minerva is fully compliant with all applicable data protection legislation and regulations, including but not limited to the General Data Protection Regulation in the European Union, to the extent that this applies to its business activities. This Privacy Statement is applicable to all interactions that entail Minerva collecting and processing Personal Data, including all forms of correspondence and visits to Minerva’s website. By continuing to use Minerva’s website you will be deemed to have agreed to Minerva processing your Personal Data and to have agreed to the terms of this Privacy Statement, a link to which is provided on Minerva’s website. In all other activities that involve the collection and processing of Personal Data, Minerva will notify you of this fact and provide a link to this Privacy Statement. In the absence of any objection to the collection and processing of your Personal Data, or if you continue to enlist the Services of Minerva or otherwise continue with the activity concerned, you will be deemed to have read, understood and consented to this Privacy Statement. This Privacy Statement does not apply to Minerva’s collection and processing of the Personal Data of its employees, freelancers or job applicants.

 

Personal Data

Personal Data is taken to mean any data you would recognise as belonging to you as well as any data from which you can be personally identified. The Personal Data that Minerva may collect from you and process includes your name, date of birth, address, e-mail address, telephone number, title/role and IP address to enable Minerva to interact with you in a commercial context or to provide support. Depending on the services you use, Minerva may also collect and process financial information, such as bank account details, payment card details, billing and other information you provide to purchase Services. The above list is not exhaustive but provides a general picture. If Minerva has to ask you to provide more Personal Data, it will specify the reason for needing to do so at the time of requesting it.

 

Minerva may receive information about you from other sources. Minerva works with third parties (e.g. payment services providers, credit agencies, subcontractors in technical services and marketing companies or organisations) and may receive Personal Data from them about you. Through marketing initiatives, Minerva may receive your Personal Data from a business or social contact.

 

Reasons for Collection and Legal Basis

Minerva collects and processes your Personal Data either to fulfil its contractual obligations to you or on the basis of legitimate interests associated with the provision of its Services. Minerva may also specifically ask for your consent to process your Personal Data in some cases. Reasons for collection include but are not limited to: providing you with information pertaining to Services you request or enquire about; providing you with information about other Services Minerva offers that are similar to those you have already purchased or enquired about; fulfilling contractual obligations to you; invoicing you and processing payment; optimising user experience when visiting Minerva’s website; handling any correspondence with you or complaints you make; and receiving information from third parties on potential or prospective Clients.

 

Minerva considers the collection and processing of Personal Data under such circumstances necessary for its legitimate interest in: the supply of information on Services it provides or offers; the fulfilment of its contractual obligations to you; the provision of support to you; invoicing you and processing payment; optimising user experience; and responding to correspondence or complaints. Parties with Access to your Personal Data

Your Personal Data will be processed by Minerva’s staff to fulfil the purposes for which it was collected. Minerva may share your Personal Data with third parties for fulfilment of the purposes for which it collects and processes your data, including but not limited to agencies, subcontractors and freelancers performing functions on its behalf, such as sending customer communications, analysing data, providing marketing assistance, processing payments, providing customer service and performing work associated with Minerva’s Services. These organisations will have access to Personal Data necessary for the performance of their functions but may not use it for any other purposes.

 

Minerva may also share your Personal Data with Internet telephony service providers, hosting centre providers or providers of SAAS such as Microsoft or any other provider of IT services or applications ancillary to the Services that Minerva offers or uses in the ordinary course of its business. If Minerva sells any business or assets, it may disclose your Personal Data to the prospective buyer of such business or assets and your Personal Data may be one of the transferred assets. If Minerva is acquired by a third party, your Personal Data will be one of the transferred assets. Retention of Personal Data

Minerva will retain your information for various different periods of time, depending upon its relationship with you and the purposes for which it has collected and processed your data. Your Rights

You are in control of the Personal Data that Minerva collects and processes and you are entitled to withdraw your consent if Minerva has obtained your consent to collecting and processing your Personal Data at any time. You are entitled to request confirmation that your Personal Data is being processed and a copy of the Personal Data being processed. Minerva shall respond to any request to the extent required by law and may charge a reasonable fee as provided by applicable law. You are entitled to request that any incorrect, incomplete or inaccurate Personal Data be amended. You are entitled to request that any Personal Data be deleted, as provided by applicable legislation, and Minerva will do so unless required or entitled to preserve the Personal Data. You are entitled to ask Minerva to temporarily restrict its processing of your Personal Data while it is investigating a complaint you have in relation to your Personal Data. You are entitled to object to Minerva’s processing of your data, including profiling of you, as provided by applicable legislation. You are entitled to object to your Personal Data being used for direct marketing services to you.

 

Minerva shall comply with all lawful requests but can refuse such requests in certain circumstances which you will be informed of if they are applicable. There are some circumstances where Minerva may be a Joint Controller of your Personal Data with another Data Controller, such as, for example, where Minerva is working with a Partner. Where Minerva is a Joint Controller, Minerva will be responsible for the Personal Data that it holds and processes. In respect of the Personal Data that Minerva holds, you can exercise the rights explained above, such as requesting amendment, deletion, etc. If you wish to exercise your rights against the other Joint Controller you may do so by contacting them.

Governing Law and Jurisdiction

This Privacy Statement shall be governed by and interpreted in accordance with the laws of England & Wales. All disputes of whatsoever nature, including failure to perform, shall be determined by the courts of England unless the applicable law is the data protection law of the country of your residence or Minerva’s relevant operation. If any doubt exists, the laws of England & Wales shall govern this Privacy Statement. In EU and EEA countries and in other countries you have the right to lodge a complaint with the relevant Supervisory Authority responsible for overseeing the processing of Personal Data.
